These Terms and Conditions govern the use of the services provided by All Access Smart Technologies trading as All Access Tutoring. By using our website, submitting an enquiry or booking tuition you agree to these Terms and to our Privacy Policy.

  1. About us

All Access Tutoring is a UK based tutoring service operated by All Access Smart Technologies as a sole trader. We provide online tutoring, academic support, university guidance, mentoring and professional development. Our contact email is support@allaccesstutoring.org.

  1. Our service

We introduce learners to suitable tutors and we continue to support the arrangement. Tutoring is delivered online. Tutors are self employed independent contractors. We monitor quality, safeguarding and progress but tutors are responsible for the delivery of their lessons.

  1. Behaviour and acceptable use

You agree to use our services in a lawful and respectful way. You must not harass, threaten or intimidate tutors, staff or other clients. You must not post or send unlawful, discriminatory or defamatory material. You must not use the service to obtain tutor or client details in order to avoid paying our fees. We may suspend or terminate access to our service if we consider behaviour to be unsafe, unprofessional or harmful.

  1. Safeguarding and vetting

We carry out enhanced checks and additional verification on tutors before they are put forward. This includes identity checks, qualification checks and advanced screening that goes beyond a standard DBS certificate. Some tutors may also be active examiners. Because lessons are online, parents and guardians remain responsible for creating a safe environment for any learner under 18. We may refuse or end tuition where safeguarding or conduct gives us concern.

  1. Tutor status and responsibilities

Tutors engaged through All Access Tutoring are self employed and are not employees of All Access Tutoring. Tutors are expected to prepare lessons, deliver them on time, teach to exam board or learning goals where relevant and provide feedback. Tutors will be asked to provide short written progress updates or reports for families. We may remove or stop putting forward any tutor who does not meet our standard of professionalism.

  1. Academic reporting

We ask tutors to submit reports after the first lesson and at reasonable intervals to help families and adult learners understand progress. Reports must be accurate and professional and must respect learner confidentiality. Repeated failure to provide reports may result in us removing the tutor from our list.

  1. Payments and plans

Lessons are paid in advance. Payments are usually taken through Stripe. In some cases we may agree to accept payment by bank transfer. Pricing depends on subject, level and tutor seniority. We have monthly subscription style learning plans because consistent sessions produce better outcomes. Where a subscription is bought, sessions should normally be used within the period agreed at the time of booking. If a family needs to pause learning for illness, travel or exams they may request a pause in writing with one month’s notice. We may agree to a short pause and extend the validity of the package but this is not guaranteed and will be decided case by case.

  1. Cooling off and refunds

You have a statutory fourteen day cooling off period from the date of your first purchase. If no lesson has taken place in that period you may cancel and receive a full refund. If lessons have already been delivered in that period we will refund only the unused portion. After the fourteen day period, refunds or cancellations are at our discretion. We may allow cancellation in exceptional or compassionate circumstances. Where we agree to a cancellation we may apply a reasonable administration or cancellation charge to cover tutor allocation, payment processing and timetable work.

  1. Cancellations and rescheduling

Lessons should be cancelled or rescheduled with at least twenty four hours notice. When lessons are cancelled late we still have to protect the tutor’s time. We therefore reserve the right to charge the full lesson fee for repeated short notice cancellations or missed sessions. We may also decide to continue without a charge where there is a genuine emergency. If a tutor cancels, we will offer another time or another tutor.

  1. Non circumvention and non solicitation

You agree that any tutor introduced to you by All Access Tutoring has been sourced, vetted and presented by us. You agree that you will not bypass us and you will not book, pay or engage that tutor privately outside All Access Tutoring for a period of twelve months from the last lesson arranged through us unless we give written consent. This protects our safeguarding process and our business. If we become aware of a breach we may charge a reasonable service fee to reflect the loss of business and we may terminate our service.

  1. Unethical practice

We do not allow or support academic dishonesty. We do not permit tutors or learners to complete assessed work for another person. Where we become aware of plagiarism, exam breaches, impersonation or other unethical practice we may stop the service immediately and no refund will be due.

  1. Discrimination and conduct

We reserve the right to refuse service where there is abusive, discriminatory or inappropriate behaviour towards tutors or staff. We select tutors based on qualification, experience and suitability and not on protected characteristics.

  1. Confidentiality

Both parties agree to keep confidential any information about the other party’s business, pricing, learners or tutors that is not publicly available. We will not share learner information with third parties except where needed to provide the service or where the law requires it.

  1. Tax

Tutors are responsible for their own tax, National Insurance and any other deductions that arise from payments they receive for tutoring. All Access Tutoring does not deduct tax on their behalf. Where we charge families, our invoices will show any applicable taxes or fees.

  1. Intellectual property

All text, layouts, processes, lesson frameworks and branding on the All Access Tutoring website belong to All Access Smart Technologies. You may not copy or reproduce our material without written permission. Lesson materials supplied by tutors are for personal use only.

  1. Liability and limitation

We will always provide our service with reasonable skill and care. However we cannot guarantee exam results, grades or university offers because these depend on the learner and on bodies outside our control. We are not liable for indirect or consequential loss such as loss of opportunity or expected grades. Nothing in these Terms limits liability for fraud or for anything that cannot be limited under English law.

  1. Termination

We may suspend or terminate the service immediately if there is misuse of the service, repeated non payment, safeguarding concerns, attempts to bypass us, abusive behaviour or breach of these Terms. You may end the service by giving us notice. Any lessons already delivered or confirmed remain payable.

  1. Breach of clause

If you breach these Terms, including the non circumvention clause, unacceptable behaviour rules or payment terms, we may stop providing services, refuse future bookings and take reasonable steps to recover losses that arise from that breach.

  1. Data protection

We process personal data in line with the UK GDPR and our Privacy Policy. We use Google Workspace, HubSpot, Stripe and our website host as data processors. By using our service you agree to that processing.

  1. Governing law

These Terms are governed by the laws of England and Wales. Any dispute will be heard in the courts of England and Wales
